Terms and Conditions
Last updated: October 29, 2026
These Terms take effect immediately for new users. For users who accepted an earlier version, they take effect on November 28, 2026.
PLEASE READ THESE TERMS CAREFULLY. SECTION 19 REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 19.
These Terms and Conditions ("Terms") are a binding agreement between you and Valestorm, Inc., doing business as Text Me That ("Valestorm," "we," "us," or "our"). They govern your use of the Text Me That mobile application, website, text messaging program, and related services (together, the "Service").
1. Agreement to These Terms
By creating an account, downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy at https://www.textmethat.io/privacy. If you do not agree, do not use the Service.
2. Who May Use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for use in the United States with a United States mobile phone number. You may not use the Service if you are barred from doing so under applicable law, or if we have previously suspended or terminated your account.
3. Your Account
You must give us accurate, complete, and current information and keep it up to date. You are responsible for keeping your account, devices, and sign-in methods secure, and for all activity that occurs under your account, whether or not you authorized it. You must notify us right away at support@textmethat.app if you learn of any unauthorized use of your account. We are not liable for any loss caused by unauthorized use of your account.
4. Subscriptions and Billing
4.1 Plans. The Service offers a free plan and paid subscription plans. Our current paid plans are:
4.1 Plans. The Service offers a free plan and paid subscription plans. Our current plans are:
| Plan | Price (US) | Texts included per month |
|---|---|---|
| Free | $0 | 15 |
| Pro | $9.99 per month, or $79.99 per year | 200 |
| Ultimate | $49.99 per month | 1,000 |
The features, prices, and allowances shown in the app at the time of purchase control. For the free plan, the features and allowance shown in the app control, and we may change them at any time. Prices may vary by country and do not include taxes, which you are responsible for.
4.2 Payment through Apple. Paid subscriptions are purchased through Apple's App Store and charged to your Apple ID account when you confirm the purchase. Apple's terms apply to that payment.
4.3 Automatic renewal. YOUR SUBSCRIPTION RENEWS AUTOMATICALLY AT THE END OF EACH BILLING PERIOD, AND YOU WILL BE CHARGED THE THEN-CURRENT PRICE, UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD. You can cancel or turn off auto-renewal at any time in your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You cannot cancel a billing period that has already started.
4.4 Free trials. If you start a free trial, your subscription will automatically convert to a paid subscription and you will be charged when the trial ends, unless you cancel at least 24 hours before the trial ends. We may limit free trials to one per person, device, Apple ID, or phone number.
4.5 Price changes. We may change subscription prices at any time. A price change takes effect at the start of your next billing period after notice is given to you, through Apple or by us. If you do not agree to a price change, you must cancel before it takes effect. Continuing your subscription after a price change takes effect means you accept the new price.
5. Text Message Allowance
5.1 No unlimited plans. Every plan, including every paid plan, has a limited number of text messages per month. No plan includes unlimited text messages.
5.2 What counts as a text. Every text message the Service sends on your behalf counts against your allowance. This includes messages sent to you and messages sent to other people, such as group or shared reminders. A message sent to more than one person counts once for each person. Mobile carriers split long messages into parts. Each part of up to 160 characters counts as a separate text. Messages that contain emoji or special characters split into parts of up to 70 characters. Picture messages may count as more than one text.
5.3 Other message types. Phone call reminders and other message types may count against your allowance or be subject to separate limits, as shown in the app.
5.4 Reset and rollover. Your allowance resets at the start of each monthly period. For yearly plans, it resets monthly on the day your subscription started. Unused texts do not roll over, have no cash value, and are not refundable.
5.5 Reaching your limit. When you reach your allowance, we will stop sending text messages until your allowance resets or you upgrade. Your reminders stay saved. We are not responsible for any reminder that is not sent because you reached your limit.
5.6 Fair use. To protect the Service and other users, we may set daily or hourly sending limits, delay or throttle messages, or limit use that we reasonably believe is excessive, automated, or abusive, even if you have not used your full monthly allowance.
6. Refunds
All purchases are processed by Apple, and Apple decides all refund requests. To request a refund, contact Apple at https://reportaproblem.apple.com. Except where required by law, we do not give refunds or credits for partial billing periods, unused texts, unused features, or periods when your account was suspended or terminated for violating these Terms.
7. Text Messaging Program
7.1 Consent. By adding your mobile phone number, you agree to receive recurring automated text messages from us at that number. These include the reminders you schedule and messages about your account. Consent is not a condition of any purchase.
7.2 Frequency and rates. Message frequency varies based on the reminders you create. Message and data rates may apply, based on your mobile carrier plan.
7.3 Opting out. Reply STOP to any message to stop receiving texts at that number. Reply START to resume. Reply HELP for help, or email support@textmethat.app. After you reply STOP, we may send one message confirming your opt-out.
7.4 Delivery. Mobile carriers are not liable for delayed or undelivered messages. We do not guarantee that any message will be delivered, delivered on time, or delivered correctly.
7.5 Changing your number. You must update your phone number in the app, or reply STOP, before you give up or transfer your number. You are responsible for messages sent to a number you no longer control.
8. Messages You Send to Other People
If you use the Service to send messages to anyone other than yourself, you are the sender of those messages, and you represent and warrant that:
- You have obtained each recipient's prior express consent, in the form required by law, to receive those text messages from you.
- You will stop sending messages to any recipient who asks you to stop, or who replies STOP.
- Your messages comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and privacy laws, and mobile carrier and industry rules.
You are solely responsible for the messages you send and for any claims arising from them. Your indemnification obligations in Section 18 cover any claim that a message sent through your account violated any law.
9. Acceptable Use
The Service is for personal, non-commercial reminders. You agree not to, and not to help anyone else:
- Send marketing, advertising, promotional, political, fundraising, or bulk messages.
- Send messages to anyone who has not consented to receive them, or who has asked you to stop.
- Send content that is unlawful, harassing, threatening, defamatory, hateful, sexually explicit, deceptive, or that impersonates any person or entity.
- Send content related to illegal drugs, firearms, gambling, or other subject matter restricted by mobile carriers.
- Use bots, scripts, or any automated means to create reminders, send messages, or access the Service.
- Share, sell, resell, sublicense, or transfer your account, subscription, or text allowance.
- Create multiple accounts, or use multiple phone numbers or Apple IDs, to get more free texts, trials, or allowance.
- Reverse engineer, decompile, scrape, copy, or interfere with the Service, or try to bypass any limit or security measure.
- Use the Service in any way that could harm us, our service providers, mobile carriers, or other users.
We decide, in our sole discretion, whether you have violated this Section.
10. Your Content
You keep ownership of the reminders, messages, and other content you submit ("Your Content"). You grant us a worldwide, royalty-free, non-exclusive license to host, store, copy, process, transmit, and display Your Content as needed to operate, maintain, and improve the Service. You represent that you have all rights needed to grant this license. We have no obligation to monitor Your Content. We may remove or refuse to send any content that we believe violates these Terms or the law.
11. Not for Emergencies or Critical Use
THE SERVICE IS A CONVENIENCE TOOL ONLY. DO NOT RELY ON IT FOR MEDICATION SCHEDULES, MEDICAL CARE, SAFETY, EMERGENCIES, LEGAL OR FINANCIAL DEADLINES, OR ANY OTHER PURPOSE WHERE A LATE OR MISSED REMINDER COULD CAUSE INJURY, DEATH, FINANCIAL LOSS, OR OTHER HARM. Reminders may be delayed, duplicated, or not delivered for many reasons, including carrier filtering, network outages, device settings, incorrect information, opt-outs, allowance limits, and errors in the Service. YOU ARE SOLELY RESPONSIBLE FOR MEETING YOUR OWN OBLIGATIONS AND KEEPING BACKUP REMINDERS. The Service does not provide medical, legal, or financial advice.
12. Third-Party Services
The Service relies on third parties, including Apple, mobile carriers, messaging providers, and calendar services, and may link to or connect with third-party websites and services. We do not control and are not responsible for any third party, its services, or its content, privacy practices, or availability. Your use of third-party services is governed by their terms.
13. Changes to the Service and Plans
We may add, change, limit, or remove any feature, plan, allowance, or part of the Service at any time. We may change the free plan at any time without notice.
If we reduce the monthly text allowance of a paid plan you are subscribed to, we will give you at least 7 days' notice through the app, by email, or by text message. The reduction will take effect at the start of your next monthly allowance period after the notice period ends. For yearly plans, this means your next monthly allowance reset, not your next yearly renewal.
We may make changes with shorter notice, or without notice, when we reasonably believe it is needed to comply with law, regulation, or mobile carrier rules, or to address fraud, abuse, or security risks.
If you do not agree to a change, you may cancel your subscription as described in Section 4.3. We are not liable to you or anyone else for any change to, or suspension or discontinuation of, the Service.
14. Suspension and Termination
We may suspend, limit, or terminate your account or access to all or part of the Service at any time, for any reason or no reason, with or without notice, including if we believe you have violated these Terms, created risk or possible legal exposure for us, or used the Service in a way that is excessive or abusive. You may stop using the Service at any time. Canceling your subscription through Apple does not delete your account. You can request account deletion in the app or at support@textmethat.app. Sections 5.4, 6, and 8 through 23, and any other provision that by its nature should survive, survive termination.
15. Intellectual Property and Feedback
The Service, including its software, design, text, graphics, logos, and the Text Me That name and marks, is owned by Valestorm, Inc. and its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app on Apple devices you own or control, for personal, non-commercial purposes, subject to these Terms. We reserve all rights not expressly granted. If you send us ideas, suggestions, or feedback, we may use them for any purpose without any obligation or payment to you.
16. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT ANY MESSAGE WILL BE DELIVERED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- IN NO EVENT WILL VALESTORM, INC. OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS (THE "VALESTORM PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, INCLUDING ANY MISSED, LATE, OR INCORRECT REMINDER.
- THE VALESTORM PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US $100).
- THESE LIMITATIONS APPLY TO ALL LEGAL THEORIES, INCLUDING CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, AND STATUTE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, our liability is limited to the smallest amount permitted by law.
18. Indemnification
You agree to defend, indemnify, and hold harmless the Valestorm Parties from and against any and all claims, demands, lawsuits, damages, losses, liabilities, fines, penalties, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Service; (b) Your Content; (c) any message sent through your account, including any claim under the TCPA or any other law governing calls, texts, or consent; (d) your violation of these Terms; or (e) your violation of any law or the rights of any third party. We may take exclusive control of the defense of any matter subject to indemnification, at your expense, and you will cooperate with our defense. You may not settle any such matter without our prior written consent.
19. Dispute Resolution: Binding Arbitration and Class Action Waiver
19.1 Informal resolution first. Before starting arbitration or any other proceeding, you and we agree to try to resolve any dispute informally for at least 60 days. To start, send a written notice describing the dispute and the relief you want, along with your name, phone number, and account email, to support@textmethat.app. We will send our notices to the email or phone number on your account.
19.2 Agreement to arbitrate. If the dispute is not resolved within 60 days, you and Valestorm agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any messages sent through the Service, including disputes about whether a dispute must be arbitrated, will be resolved by binding individual arbitration and not in court. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, before a single arbitrator. The Federal Arbitration Act governs this Section 19. Unless the arbitrator decides that a hearing is necessary, the arbitration will be conducted by documents, phone, or video. Any in-person hearing will take place in the county where you live or in Texas. Fees will be paid as provided by the AAA rules.
19.3 Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek an injunction in court to protect its intellectual property rights.
19.4 Class action and jury trial waiver. YOU AND VALESTORM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine more than one person's claims and may award relief only to the individual party seeking it. YOU AND VALESTORM EACH WAIVE THE RIGHT TO A JURY TRIAL.
19.5 Mass filings. If 25 or more similar demands for arbitration are filed against us by or with the help of the same law firm or organization, they will be administered in batches of up to 25 demands, with one batch at a time proceeding to arbitration, to the extent permitted by the AAA rules.
19.6 Time limit. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
19.7 Opting out. You may opt out of this Section 19 by emailing support@textmethat.app within 30 days after you first accept these Terms, or this version of them. Your email must include your name, phone number, account email, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
19.8 Severability. If the class action waiver in Section 19.4 is found unenforceable for any claim, that claim must be severed and decided in court under Section 20, and the rest of this Section 19 still applies. If any other part of this Section 19 is found unenforceable, the rest remains in effect.
20. Governing Law and Venue
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. For any dispute not subject to arbitration, you and Valestorm agree to the exclusive jurisdiction and venue of the state and federal courts located in Texas.
21. Apple App Store Terms
If you downloaded the app from Apple's App Store:
- These Terms are between you and Valestorm only, not Apple. Valestorm, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and consumer protection or privacy claims.
- Apple is not responsible for any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
22. Changes to These Terms
We may modify these Terms at any time. We will post the updated Terms with a new "Last updated" date. For material changes, we will give you at least 7 days' notice through the app, by email, or by text message before they take effect. We decide in our sole discretion what counts as a material change. Changes needed to comply with law, regulation, or mobile carrier rules may take effect immediately. Changes to Section 19 will not apply to any dispute that you or we gave notice of before the change was posted. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service and cancel your subscription.
23. General Terms
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service, and they replace all prior agreements and versions.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent possible, and the remaining provisions stay in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms at any time without notice, including in a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control. These include carrier or network failures, outages of third-party providers, changes in carrier rules, natural disasters, war, labor disputes, and government actions.
- Electronic communications. You agree that we may communicate with you electronically, by in-app notice, email, or text message. Electronic communications satisfy any legal requirement that a communication be in writing.
- Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
- Headings. Section headings are for convenience only and do not affect how these Terms are interpreted.
