This Privacy Policy explains how Valestorm, Inc., doing business as Text Me That ("Valestorm," "we," "us," or "our"), collects, uses, shares, and protects information when you use the Text Me That mobile application, website, text messaging program, and related services (together, the "Service").

By using the Service, you agree to this Privacy Policy and to our Terms and Conditions at https://www.textmethat.io/terms-conditions. If you do not agree, do not use the Service.

1. Information We Collect

1.1 Information you give us

  1. Account information: your mobile phone number, name, email address, and time zone.
  2. Reminder content: the text of your reminders, their schedules, repeat settings, and any notes you add.
  3. Information about other people: names and phone numbers of people you send or share reminders with.
  4. Support messages: what you send us when you contact support, including through in-app chat.
  5. Survey and onboarding answers: choices you make when setting up the app.

1.2 Information we collect automatically

  1. Device information: device type and model, operating system and version, app version, language, and time zone.
  2. Identifiers: your account ID, device and advertising identifiers (if you allow tracking), and push notification tokens.
  3. Usage information: the screens you view, the features you use, the reminders you create, and the messages we send.
  4. Technical information: IP address, crash reports, error logs, and performance data.
  5. Message delivery information: whether a text was delivered, failed, or was replied to, including STOP and HELP replies.

1.3 Information you allow through device permissions

  1. Location: if you create location-based reminders, we collect and store the places you choose, and the app uses your device's location to trigger those reminders.
  2. Calendar: if you turn on calendar sync, the app adds reminders to your device calendar.
  3. Contacts: if you pick a contact to share a reminder with, we receive only the contacts you choose. We do not upload your full address book.
  4. Notifications: if you allow push notifications, we send you reminders and account messages.
  5. Tracking: if you allow tracking when the app asks, we and our advertising partners may use your device's advertising identifier, as described in Section 5.

You can turn any permission off in your device settings at any time. Some features will not work without them.

1.4 Information from others

  1. Apple and our subscription provider: your subscription status, purchase history, and trial status. We do not receive your full payment card details.
  2. Advertising partners: information about which ad or campaign led you to install the app.
  3. Other users: your name and phone number, if another user adds you as a recipient of a reminder.

2. How We Use Information

We use information to:

  1. Provide the Service, including creating your account, verifying your phone number, and sending your reminders by text, call, or notification.
  2. Process subscriptions, manage free trials, and enforce plan limits, including text message allowances.
  3. Communicate with you about your account, the Service, and changes to our Terms or this Privacy Policy.
  4. Send marketing and promotional emails and push notifications. You can opt out of these at any time.
  5. Provide customer support.
  6. Measure and improve the Service, develop new features, and understand how people use the app.
  7. Measure and improve our advertising.
  8. Detect, prevent, and respond to fraud, abuse, spam, security incidents, and violations of our Terms.
  9. Comply with law, enforce our rights, and protect the rights, safety, and property of Valestorm, our users, and others.

We may also create de-identified or aggregated information that does not reasonably identify you, and use it for any lawful purpose.

3. How We Share Information

3.1 Service providers. We share information with companies that perform services for us, under contracts that limit how they may use it. These include:

3.2 Advertising partners. If you allow tracking, we share limited device, identifier, and app-activity information with advertising partners, such as Meta and Apple, to measure ads and show you more relevant ads. See Section 5.

3.3 People you send reminders to. When you send or share a reminder with someone, they receive the reminder text and may see your name or phone number.

3.4 Legal and safety. We may disclose information if we believe in good faith it is necessary to comply with a law, subpoena, court order, or government request; to enforce our Terms; to investigate fraud, abuse, or security issues; or to protect the rights, safety, or property of Valestorm, our users, or others.

3.5 Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, information may be transferred as part of that transaction.

3.6 With your consent. We may share information for other purposes with your consent or at your direction.

4. Text Messaging and Mobile Information

We do not share or sell your mobile phone number or text messaging opt-in data with third parties or affiliates for their marketing or promotional purposes. We share mobile information only with service providers that help us run the text messaging program, such as our messaging provider and mobile carriers, and as required by law.

Reply STOP to any text to stop receiving texts. Reply HELP for help. Message and data rates may apply.

5. Advertising and Tracking

The app asks for your permission before tracking you across other companies' apps and websites, as required by Apple. If you allow it, we and our advertising partners may use your device's advertising identifier and app-activity information to measure ad performance and show you relevant ads. If you do not allow it, we do not use your advertising identifier for tracking, but we and our partners may still use limited, non-identifying information to measure installs and ad performance.

You can change this at any time on iPhone under Settings > Privacy & Security > Tracking. You can also opt out of personalized ads from Apple under Settings > Privacy & Security > Apple Advertising.

6. Your Choices

  1. Marketing emails: use the unsubscribe link in any marketing email.
  2. Push notifications: turn them off in your device settings.
  3. Text messages: reply STOP to any text.
  4. Device permissions: change location, calendar, contacts, and tracking access in your device settings.
  5. Account deletion: delete your account in the app under Settings, or email support@textmethat.app.

7. How Long We Keep Information

We keep information for as long as your account is active and as long as needed to provide the Service, comply with legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements. When you delete your account, we delete or de-identify your personal information within a reasonable time, except for information we must keep to comply with law, for security or fraud prevention, for tax and accounting records, to keep a record of text message opt-outs, or as part of routine backups until they are overwritten.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information. Information is encrypted in transit and stored with cloud providers that encrypt data at rest. Your reminders are not end-to-end encrypted, and our personnel and service providers can access them as needed to operate and support the Service. No method of transmission or storage is completely secure, and we cannot guarantee the security of your information. Do not put passwords, financial account numbers, Social Security numbers, health records, or other sensitive information in your reminders.

9. Children

The Service is not intended for anyone under 18. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us at support@textmethat.app, and we will delete it.

10. Your State Privacy Rights

Depending on where you live, you may have the right to:

  1. Know and access the personal information we have about you.
  2. Correct inaccurate personal information.
  3. Delete your personal information.
  4. Get a copy of your personal information in a portable format.
  5. Opt out of targeted advertising, the "sale" of personal information, or the "sharing" of personal information for cross-context behavioral advertising.

We do not sell personal information for money. Some state laws may treat sharing information with advertising partners, as described in Section 5, as a "sale," "sharing," or "targeted advertising." To opt out, turn off tracking as described in Section 5, and email us at support@textmethat.app with the subject "Do Not Sell or Share."

To make a request, email support@textmethat.app from the email address on your account, or include your account phone number. We will verify your identity before responding, and we may deny requests we cannot verify or that the law allows us to refuse. You may use an authorized agent, who must provide proof that you authorized them. If we deny your request, you may appeal by replying to our decision with the subject "Appeal." We will not discriminate against you for exercising these rights.

We do not use or disclose sensitive personal information to infer characteristics about you. We collect precise location only for location-based reminders you create.

11. Users Outside the United States

The Service is intended for users in the United States. Information is processed and stored in the United States. If you use the Service from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those where you live.

12. Third-Party Links and Services

The Service may link to or connect with third-party websites and services, such as Apple, calendar apps, and support tools. We are not responsible for their privacy practices. Their own privacy policies apply.

13. Changes to This Privacy Policy

We may update this Privacy Policy at any time. We will post the updated version with a new "Last updated" date. If we make material changes, we will notify you through the app, by email, or by text message before the changes take effect. Your continued use of the Service after the changes take effect means you accept the updated Privacy Policy.
